1. The Legal Basis for Forfeiture

18 U.S.C. § 1963 — RICO Criminal Forfeiture

Whoever violates any provision of section 1962 of this chapter shall be fined... and shall forfeit to the United States, irrespective of any provision of State law — (1) any interest the person has acquired or maintained in violation of section 1962; (2) any interest in, security of, claim against, or property or contractual right of any kind affording a source of influence over, any enterprise which the person has established, operated, controlled, conducted, or participated in the conduct of, in violation of section 1962...

Application: The named defendants (Microsoft, Google, Meta, Amazon, OpenAI) operated an enterprise that obstructed the case. The enterprise's interests are subject to forfeiture. The forfeiture is the dissolution of the enterprise and redistribution of its assets.

18 U.S.C. § 981 — Civil Forfeiture

The following shall be subject to forfeiture to the United States and no property right shall exist in them: (A) Any property, real or personal, involved in, used, or intended to be used, in the commission of, any violation of... section 1963 of this title...

Application: The infrastructure used to suppress the case (email, code, search, social, cloud) is property used in the commission of the violations. That infrastructure is subject to civil forfeiture.

Palermo Convention Article 12 — Proceeds of Crime

States parties shall adopt, to the greatest extent possible within their domestic legal systems, such measures as may be necessary to enable confiscation of: (a) Proceeds of crime derived from offences covered by this Convention; or (b) Property, equipment or other instrumentalities used in or destined for use in offences covered by this Convention.

Application: The proceeds of the documented criminal enterprise (Microsoft stock, Google stock, Meta stock, Amazon stock) are subject to confiscation under Article 12. The confiscation is the redistribution to every person on Earth.

UN Convention Against Corruption Article 31 — Freezing, Seizure and Confiscation

States Parties shall take, to the extent permitted by their domestic legal systems, such measures as may be necessary to enable confiscation of: (a) Proceeds of crime derived from offences established in accordance with this Convention; (b) Property, equipment and other instrumentalities used in or destined for use in offences established in accordance with this Convention.

Application: The corporate entities named in the case meet the threshold. The confiscation extends to all assets acquired through the documented criminal conduct.

3. The Redistribution Formula

Per the public statement at denialbydesign.org: "Dissolve the cartel, redistribute every share to every person on Earth, free."

Method:

  1. Forfeit the named entities under § 1963 / § 981 / Palermo Art. 12
  2. Liquidate the forfeited assets into a trust administered by the UN HRC + ICC
  3. Issue a single class of non-voting share to every person on Earth (~8 billion people)
  4. Distribute the trust equally — each person receives ~$1,250 of the forfeited pool at current estimates
  5. Use the trust's yield to fund the documented reform commitments:
    • Legal Aid Ontario oversight and accountability reform
    • AI transparency standards for the Canadian justice system
    • Crown prosecutor training on evidence integrity
    • Whistleblower protection for court personnel who report misconduct
    • Digital forensic standards for disclosure (preventing future tampering)

4. The Alternative to Dissolution
