# HABEAS SUBMISSION CHAIN RECONSTRUCTION — SCJ WINDSOR, DEC 2025 – FEB 2026

Prepared Oct 27, 2026. Timeline work only — nothing sent. Every quote below is verbatim from the document named beside it. Stores searched: Gmail (connector, full-window sender and keyword sweeps), the saved-mail corpus at `~/workspace/email/gmail/`, the matrix work files at `~/workspace/vc_matrix_work/` (raw message bodies + both endorsement PDFs), the Gmail attachments preserved under `~/workspace/your_files/first_pull_hunt_oct22/`, and the Google Drive pull at `~/workspace/gdrive_pull/files/`.

Companion file: `~/workspace/your_files/no_active_matters_verbatim_oct27.md` (tonight's verbatim hunt — the Crown/SCJ "no active matters" letters are documented there and are not repeated here except where they sit in the chain).

## PART 1 — OUTBOUND: EVERY HABEAS COMMUNICATION FROM FRANK TO THE COURTS

### O-1 — Dec 26, 2025 (filing date) / emailed Dec 30, 2025, 13:59 EST — Form 14A habeas application, SCJ Windsor

- Gmail `19b70a0ed8678917`, Frank → **windsor.scj@ontario.ca only**.
- Subject (verbatim): "Subject: Form 14A - Completing Habeas Corpus Application (Filed Dec 26, 2025) - Francesco Longo - Case #94545"
- Body: "Please see the attached signed Form 14A for the above application, filed December 26, 2025. The full application package (Form 14B and Exhibits) will follow by separate delivery this week."
- Attachment: "SIGNED 14A HABEOUS WINDSOR 2021 2025.pdf" (186,792 bytes; preserved copy at `~/workspace/your_files/first_pull_hunt_oct22/gmail_SIGNED_14A_HABEAS_WINDSOR.pdf`).
- Dorsey cited: **the email does not cite Dorsey.** The Form 14A attachment itself was located but its title page text was not extracted in this pass — the instrument's own printed title is therefore **not quoted here** rather than reconstructed.
- Re-sent by Frank Jan 1, 2026, 17:41 (Gmail `19b7bb8ba69ec7a5`, same subject/attachment).

### O-1A — Dec 26, 2025 — two habeas-application emails to Windsor SCJ the same day (complete-triage supplement)

*Added on the complete Windsor-bound triage (49 messages to windsor.scj@ontario.ca in the window). Subjects verbatim; bodies not read in this pass, so nothing further is claimed for them.*

- **Dec 26, 2025, 10:56 EST** — Gmail `19b5b5fe0cd87c69`, subject: "**SUBJECT: R. v. LONGO #94545 - HABEAS CORPUS APPLICATION - IMMEDIATE PAYMENT DEMANDED $57,650,000**"
- **Dec 26, 2025, 12:12 EST** — Gmail `19b5ba5ebe91384b`, subject: "SUBJECT: R. v. LONGO #94545 / #21-38609 / #21-38605 / #211549 - HABEAS CORPUS APPLICATION - IMMEDIATE PAYMENT DEMANDED $57,650,000"
- Two further Dec 26 filings the same morning (09:09, Gmail `19b5afe8438ee0c4`; 09:45, Gmail `19b5b1f6a0daac7d`) carry the subject "EMERGENCY FILING - SIX APPLICATIONS - R. v. Longo (Case #94545)…"; whether a habeas instrument is among the six is **not established** — bodies not read.
- Dorsey cited: not established (subjects carry no citation).
- The Jan 26 original (O-3) also appears in the triage as **two** forwards to Windsor that afternoon: 16:18:55 (Gmail `19bfc2c9a8ea9f7f`) and 16:43:39 (Gmail `19bfc433dd7b7ed1`).
- **The February demand copies (O-9) are now located by subject line:** Feb 11, 2026, 13:27 (Gmail `19c4df50fc17adef`, "Subject: URGENT: HABEAS CORPUS RESPONSE DEMAND - CJC FORGED ORDER PROOF - DEADLINE TODAY"); Feb 17, 2026, 01:38 (Gmail `19c6a51f5e911b3a`, in the renewed-application thread, "Re: URGENT Habeas Corpus Application - Longo v. Her Majesty the Queen") and Feb 17, 15:45 + 16:03 (Gmail `19c6d59f7187728f`, `19c6d69e55bc72db` — the Rule 43 Mandamus demands "FORCE DECISION ON HABEAS (LONGO V. CARROCCIA)").

### O-2 — Jan 2, 2026, 10:49:30 EST — "Emergency Motion to Amend Habeas Corpus," SCJ Windsor + others

- Gmail `19b7f6659d62f924`, Frank → Windsor SCJ, Ottawa SCJ, Toronto SCJ, CJC, Ombudsman, media.
- Subject (verbatim): "Subject: URGENT: Emergency Motion to Amend Habeas Corpus — 20-Year Kidnapping & Database Fraud"
- Forwarded by Frank within the hour to further recipients (Gmail `19b7f6b2a4704fa0`, `19b7f6c93f250843`, `19b7f6d69e9c8222`, `19b7f6debb76749c`, `19b7f6ec16bbb587`).
- Dorsey cited: **not established** — the subject line carries no citation; the motion document's own title page was not located in this pass, so no title is quoted for it.
- Frank's confirmation request the same morning, Jan 2, 11:18 (Gmail `19b7f8024a4d66ed`): "Per my email at 10:49 AM with 12 exhibits, please confirm receipt of the Emergency Habeas Communication and Amendment." — it is this thread that Gibson's Jan 5 reply (I-1) answers.

### O-3 — Jan 26, 2026, 4:04 PM EST — the ORIGINAL habeas application email, to OTTAWA SCJ; forwarded to Windsor SCJ 4:19 PM

- Sent to **ottawa.scj@ontario.ca**; Cc Toronto SCJ, Hamilton SCJ, Attorney General, RCMP/OPP commissioners, SIU, CJC, Ombudsman, OHCHR Petitions, CBC tips, Toronto Star, Windsor Star, CTV, Global. Forwarded by Frank to Windsor SCJ the same afternoon (4:19 PM). The full text survives quoted inside the Jan 27 reply file `~/workspace/vc_matrix_work/raw_19bffe3d17f33682.body.txt`; outbound Gmail Message-IDs `CAFgAk4H3ua4Can+U7b=JE5m-F5=55kCsLFj_FrsLwgzj+VuA2Q` and `CAFgAk4EinQ1eYE=yGJbQLOMJpUSVwEvZckKVZ4AgpkULuSCOrA`.
- Subject (verbatim): "**EMERGENCY HABEAS CORPUS APPLICATION — Francesco Longo — Unlawful Arrest + Spoliation + Fabricated Charges**"
- Opening words of the instrument (verbatim): "I, Francesco Giovanni Longo, hereby file an EMERGENCY APPLICATION FOR WRIT OF HABEAS CORPUS with supporting evidence of: 1. Unlawful arrest (May 6, 2021 — no charge; Occurrence #21-38605) 2. Spoliation of evidence (May 24, 2021 call recording; LECA file) 3. Ab initio nullity (fraudulent 2005 US conviction; no lawful extradition) 4. Criminal conspiracy (Ashley Dale, Christina Krainz, Windsor Police, RCMP)"
- Dorsey cited: **NO.** A full-text search of the preserved email returns **zero** occurrences of "Dorsey" and zero of "systemic criminal conspiracy." Frank's memory on this point is sustained by the document.
- A Gmail print of this email also survives at `~/workspace/gdrive_pull/files/1UO6XCFHUxzF_EMERGENCY HABEAS CORPUS APPLICATION ottowa scj gmail.pdf` (image-only PDF).

### O-4 — Jan 28, 2026, 14:28:47 EST — "Response to Rejection" — Dorsey raised for the first time

- Gmail `19c061473b57b810` (thread `19c0606cad8010c5`); saved copy `~/workspace/email/gmail/dba34f1d373e35984d8a31069f004fad59b19e4dd47cfd0fcc2c1c05359e039e.md`. Frank → Windsor SCJ.
- Subject (verbatim): "URGENT Habeas Corpus Application - Francesco Longo - Response to Rejection"
- Body (verbatim, in part): "Please find attached my Response to Court Rejection and Renewed Application for Writ of Habeas Corpus with all supporting exhibits. **This application responds to the rejection of January 27, 2026, 9:37 AM, and provides binding Supreme Court precedent (Dorsey v. Canada, 2025 SCC 38, decided November 21, 2025) that requires immediate consideration.**"
- **Attachment inventory caveat (documented, not glossed):** the 29 attachments on this email are exhibits (court documents, police/Crown correspondence, case-law PDFs). The renewed application document itself is **not** among them; the body carries four Google Drive links (audio/memo exhibits). The signed renewed application was transmitted 62 minutes later as O-5.

### O-5 — Jan 28, 2026, 15:30:41 EST — the RENEWED APPLICATION document (the instrument Carroccia's endorsement answers)

- Gmail `19c064d23e74316b`, Frank → Windsor SCJ + Ottawa SCJ + Toronto/Hamilton SCJ + OPP/SIU/CJC/Ombudsman/RCMP/AG/OHCHR/media.
- Subject (verbatim): "URGENT Habeas Corpus Application - Longo v. Her Majesty the Queen"
- Attachment: "HABEAS CORPUS RESPONSE SIGNED DEEP SEEK PDF.pdf" (444,805 bytes). Two identical Drive copies: `~/workspace/gdrive_pull/files/1fXhRFMhB5KP_HABEAS CORPUS RESPONSE SIGNED DEEP SEEK PDF.pdf` and `~/workspace/gdrive_pull/files/1Y81QWuiXkjf_HABEAS CORPUS RESPONSE SIGNED DEEP SEEK PDF.pdf`. The PDF's internal CreationDate is **Wed Jan 28 20:13:16 2026 UTC = 3:13 PM EST** — 17 minutes before this email was sent.
- **Title as printed on the document's own title page (verbatim, capitals as on the document):**

  > ONTARIO SUPERIOR COURT OF JUSTICE
  > Court File No: [To be assigned by Court]
  > FRANCESCO GIOVANNI LONGO (Applicant, Self-Represented, 5816 Tecumseh Road East, Windsor, ON N8T 1E2) v. HER MAJESTY THE QUEEN
  > **APPLICATION FOR WRIT OF HABEAS CORPUS WITH EVIDENCE OF SYSTEMIC CRIMINAL CONSPIRACY**
  > TO: The Honourable Justice, Ontario Superior Court of Justice, 245 Windsor Avenue, Windsor, Ontario N9A 5K1
  > **DATE: January 29, 2026**

- Para 1.1 (verbatim): "I, Francesco Giovanni Longo, bring this Application for Writ of Habeas Corpus to expose and remedy a systemic criminal conspiracy operating within Windsor institutions since 2021."
- Dorsey cited: **YES — twice**, including §8.2: "DORSEY v. CANADA, 2025 SCC 38: (a) Physical custody not required for habeas corpus… (d) Under Dorsey's three-stage test, the onus shifts to the Crown to justify these restrictions, which they cannot do given their admission of 'no active files'…"

### O-6 — Jan 28, 2026, 16:15 and 16:53 EST — court-documents transmissions, same thread

- Gmail `19c0675ea155117d` (16:15, subject "Re: URGENT - HABEAS CORPUS APPLICATION - Francesco Longo - Response to Rejection") and Gmail `19c0698c58034cdf` (16:53, "Please see the attached court documents."). Supporting-document sends in the Jan 28 filing thread; no new instrument title.

### O-7 — Jan 29, 2026, 12:40 / 12:48 / 14:27 EST — follow-on transmissions after the endorsement arrived

- Gmail `19c0ad81008b944d` (12:40, "Re: URGENT Habeas Corpus Application - Francesco Longo - Response to Rejection" — sent ~4 hours after the endorsement was transmitted to him), `19c0adf5b2cb4896` (12:48) and `19c0b39ced5f892e` (14:27), both "Please see the attached documents."

### O-8 — Jan 30, 2026, 10:43 EST — complete evidence package

- Gmail `19c0f92cf110143c`, subject (verbatim): "URGENT - Complete Evidence Package with Proven Forgery & Perjury - Francesco Longo Habeas Corpus - Irrefutable Visual Proof (2004-2026…)".

### O-9 — Feb 11, 2026 and Feb 17, 2026 — the February demands directed to Carroccia J.

- These two emails are known verbatim through Hebner J.'s endorsement (I-8 below), which recites them:
 - **Feb 11, 2026** (to Carroccia J.): demanding an immediate response to his habeas corpus application; a $57 million deposit; arrest orders for AG Arif Virani, AG Ontario Doug Downey, Premier Doug Ford and Minister Michael Kerzner; and that she "contact RCMP to execute."
 - **Feb 17, 2026**: demanding "immediate processing of this Rule 43 Mandamus Application to force The Honourable Justice Maria V. Carroccia to decide my habeas corpus."
- A Frank message of Feb 12, 20:44:54 ("Re: EMERGENCY…") appears in the habeas search results in truncated form and is likely part of the Feb 11 demand thread; its full body was not read in this pass and nothing is quoted from it.

## PART 2 — INBOUND: EVERY RESPONSE, IN ORDER

Complete inbound from windsor.scj@ontario.ca, Dec 1, 2025 – Mar 1, 2026, is exactly **eight messages**. All substantive ones are signed by **Samantha Gibson, Trial Coordinator–Criminal** — staff, not a judge — until the two endorsements.

| # | Date | Author / form | Answers | Dorsey? | Substance |
|---|------|---------------|---------|---------|-----------|
| I-1 | Jan 5, 2026 (`19b8edfdd285a16e`) | Gibson, staff letter | O-2 (Jan 2 amendment thread) | No | "A file number has not been assigned. The application is not proper." |
| I-2 | Jan 15, 2026 (`19bc2704a37acfe6`) | Gibson, staff letter | Frank's Jan 7, 2026 **mandamus** application | No | Filing refused. "From our records, you do not have any criminal matters pending in the Superior Court of Justice at Windsor." |
| I-3 | **Jan 27, 2026, 09:37 EST** (`19bffe3d17f33682`) | Gibson, staff letter | **O-3 (the Jan 26 original habeas)** | **No** | "Your application cannot be accepted by the court. A Habeas corpus can only be filed by a person is in custody." + a rules/format sentence. **This is the original denial. It predates any mention of Dorsey by anyone, and it is a staff letter, not a judge's endorsement.** |
| I-4 | Jan 28, 2026 (`19c06721f5f9b62b`) | Gibson, staff letter | Frank's Jan 28, 16:15 court-documents thread | No | "Your file from 2005 has been received from archives. What documents do you require from the file?" |
| I-5 | **Jan 29, 2026, 08:42 EST** (`19c09fd7da208c08`) | Gibson, transmittal | **O-4/O-5 (the Jan 28 renewed application)** | — | "This filing will not be accepted. Please see attached the endorsement from Local Administrative Judge, Justice Carroccia." Attachment: **Carroccia J.'s signed endorsement dated Jan 28, 2026** (`~/workspace/vc_matrix_work/carroccia_endorsement_jan28_2026.pdf`). |
| I-6 | Jan 29, 2026, 18:14 UTC (`19c0af6b54889506`) | Gibson, staff letter | Frank's document requests | No | "The Windsor Superior Court does not have access to files from the Ontario Court of Justice. You will need to make inquiries with that court." |
| I-7 | Feb 5, 2026 (`19c2fa639ef7e64f`) | Gibson, staff letter | Frank's document requests | No | "There are no other documents in the file." |
| I-8 | Feb 26, 2026 | **Hebner J., endorsement** (transmitted by Gibson) | O-9 (the Feb 11 + Feb 17 demands) | Recites the chain | "The email requesting habeas corpus was considered by Carroccia J on January 28, 2026." Finds the s. 140 vexatious-litigant hallmarks (a), (b), (d) appear satisfied; the court is considering a s. 140 order; registrar directed to prepare a notice; Frank has 20 days to respond in Form 2.2D. Dating note: the preserved text copy's DATE field is blank — the **Feb 26, 2026** date is established by the transmittal and the file record (see the verbatim hunt file). Whether any registrar's notice was ever served or any order made is **not** established by these documents. |

**No inbound response from Ottawa SCJ** (the addressee of the Jan 26 original) appears anywhere in the window's stores.

## PART 3 — FRANK'S THREE QUESTIONS, ANSWERED ON THE DOCUMENTS

### Q1 — Was there a previous response from Carroccia (or the court) to the original habeas, before Jan 28, 2026?

**From Carroccia J.: NO — honest null.** No Carroccia-authored or Carroccia-transmitted document dated before the Jan 28, 2026 endorsement exists in any store searched: the Gmail full-window sender sweep from windsor.scj@ontario.ca (exactly 8 inbound messages, listed above), the saved-mail corpus `~/workspace/email/gmail/`, and the `~/workspace/vc_matrix_work/` raw files. The endorsement of Jan 28 is the first document bearing her name in the entire chain.

**From the court (staff): YES — three, none of them hers.** Gibson's Jan 5 letter (answering the Jan 2 amendment thread), her Jan 15 letter (answering the Jan 7 mandamus), and her **Jan 27 letter — the original denial of the habeas itself**, on the custody ground, with no mention of Dorsey because Frank had not yet raised it.

### Q2 — Is the Jan 28 endorsement a first response or a second one?

**It is the second response to the habeas — and the first from a judge.** The sequence on the documents:

1. **Jan 27, 09:37** — Gibson (staff) denies the Jan 26 original: custody ground only, no Dorsey.
2. **Jan 28, 14:28** — Frank's "Response to Rejection" answers that denial and raises **Dorsey v. Canada, 2025 SCC 38** for the first time ("provides binding Supreme Court precedent (Dorsey v. Canada, 2025 SCC 38, decided November 21, 2025) that requires immediate consideration").
3. **Jan 28, 15:30** — Frank sends the signed renewed application (O-5), the document that carries the quoted title and cites Dorsey twice.
4. **Jan 28 (dated) / Jan 29, 08:42 (transmitted)** — Carroccia J.'s endorsement refuses the filing. On its own face it answers the **renewed** application, not the Jan 26 original: it quotes the renewed application's title verbatim (Q3 below), quotes its remedy ("expose and remedy a systemic criminal conspiracy operating within Windsor institutions since 2021" — para 1.1 of the renewed application, word for word), and engages Dorsey at para 44 — material that exists **only** in the Jan 28 submissions. The Jan 26 original contains neither the title nor Dorsey (zero occurrences of each in the preserved text).
5. Hebner J.'s Feb 26 endorsement confirms the court's own understanding of the sequence: "The email requesting habeas corpus was considered by Carroccia J on January 28, 2026" — i.e., one consideration by Carroccia, on Jan 28, after the Jan 27 staff denial.

**Timing nuance, stated and not over-read:** the endorsement is *dated* Jan 28; the renewed-application PDF is internally *dated* Jan 29, 2026 on its title page, was *created* Jan 28 at 3:13 PM EST, and was *emailed* Jan 28 at 3:30 PM EST; the endorsement reached Frank Jan 29 at 08:42 EST. The documents therefore fix that the endorsement responds to the Jan 28 Dorsey-raising renewal; they do not fix the exact hour Carroccia received the signed PDF as against Frank's 14:28 email announcing it.

**Frank's memory is sustained on every checkable point:** the original denial did not address Dorsey; he raised Dorsey afterward; the Jan 28 endorsement is not the court's initial response — it is the second response, and the first by a judge.

### Q3 — What did Frank actually title his habeas instrument? Is Carroccia's quotation his title verbatim?

**Two different instruments, two different titles — and Carroccia quoted the second one accurately.**

- The **original** (Jan 26, O-3) bore no such title. Its subject line: "EMERGENCY HABEAS CORPUS APPLICATION — Francesco Longo — Unlawful Arrest + Spoliation + Fabricated Charges"; its opening: "I, Francesco Giovanni Longo, hereby file an EMERGENCY APPLICATION FOR WRIT OF HABEAS CORPUS…"
- The **renewed application** (Jan 28/29, O-5), title page, verbatim:

  > "APPLICATION FOR WRIT OF HABEAS CORPUS WITH EVIDENCE OF SYSTEMIC CRIMINAL CONSPIRACY"

- Carroccia J.'s endorsement (preserved text, `~/workspace/vc_matrix_work/carroccia_endorsement_jan28_2026.txt`):

  > "Mr. Francesco Longo seeks to file what he titles 'Application for writ of habeas corpus with evidence of systemic criminal conspiracy'."

**Comparison:** the wording is **identical, word for word, all twelve words in the same order** — Application / for / writ / of / habeas / corpus / with / evidence / of / systemic / criminal / conspiracy. The only difference is typography: Frank's title page is set in all capitals; the endorsement renders it in sentence case. Nothing is dropped, added, or reworded. Her phrase "what he titles" is accurate — **of the renewed application**. It is not, and could not be, a quotation of the Jan 26 original, which never carried that title.

---

## PART 4 — SUBMISSIONS THAT RECEIVED NO RESPONSE IN THE WINDOW

1. **The Jan 26 original as sent to Ottawa SCJ** — no Ottawa SCJ reply exists in any store searched. (Windsor answered its forwarded copy, I-3.)
2. **The Jan 30 complete evidence package (O-8)** — no response in the window; the next inbound of any kind is Gibson's Feb 5 "no other documents" (a document-request reply) and then Hebner's Feb 26 endorsement, which recites the February demands but does not answer the Jan 30 package.
3. **The Feb 11 and Feb 17 demands (O-9)** — no direct reply to either; both are answered only collectively, by recital, inside Hebner J.'s Feb 26 endorsement.
4. **The Dec 26 Form 14A filing (O-1)** — never answered under its own subject line; Gibson's Jan 5 reply answers the Jan 2 amendment thread and does not state that it disposes of the Dec 26 filing.
5. **The Dec 26 habeas-application emails (O-1A)** — no response under their own subject lines either; the first inbound of any kind in the chain is Gibson's Jan 5 letter (I-1), answering the Jan 2 thread.

## ADDENDUM — DORSEY, READ WHOLE, AGAINST THE ENDORSEMENT

*Dorsey v. Canada (Attorney General), 2025 SCC 38. Judgment November 21, 2025; SCC docket 41132; heard May 13, 2025; on appeal from the Court of Appeal for Ontario. Source note: the SCC decisions site and CanLII both returned 403 to the fetcher in this pass; the full judgment text below was read from the complete judgment PDF and cross-checked against the Supreme Court's own Case in Brief page and the judgment's headnote. Paragraph numbers are the judgment's own.*

**The court and the split — settled first, because a claim about it is in circulation:** the decision was **6–3, not unanimous**. Majority reasons (paras 1–90): **Moreau J.**, with Wagner C.J. and **Karakatsanis**, Martin, Kasirer and O'Bonsawin JJ. concurring. Joint dissenting reasons (paras 91–208): Côté and Rowe JJ., Jamal J. concurring. The appellants, Frank Dorsey and Ghassan Salah, were **incarcerated federal inmates** denied reclassification from medium to minimum security. The sole issue, para 29 (verbatim): "Is habeas corpus available to challenge CSC's refusal to reclassify an inmate to a lower security level?"

### A. The test, as the majority states it

The majority states **two elements** proceeding in **three stages**. Para 36 (verbatim): "The criteria for a successful habeas corpus application are well established, requiring (1) a deprivation of liberty and (2) that the deprivation be unlawful (Khela, at para. 30)." Para 37: "The application for habeas corpus proceeds in three stages." Para 38 (verbatim, in substance): "As a threshold matter, legal access to the writ requires that an applicant establish that they have been deprived of liberty. Once a deprivation of liberty is proven, the applicant must raise a legitimate ground upon which to question its legality. If the applicant has raised such a ground, the onus shifts to the respondent authorities to show that the deprivation of liberty was lawful (Khela, at para. 30…)."

Two load-bearing consequences the majority states expressly:

- **The hearing is mandatory once the threshold is met.** Para 47 (verbatim): "It bears repeating that the writ of habeas corpus is non-discretionary, meaning that 'the matter must proceed to a hearing if the inmate shows some basis for concluding that the detention is unlawful' (Khela, at para. 41 (emphasis in original))." Para 7 is to the same effect: "Should an inmate prove a deprivation of liberty and raise a legitimate ground to question the legality of the deprivation, a hearing on the merits must follow."
- **Stage two is a real but low gate.** Para 46 (verbatim): "the applicant's allegations and grounds pleaded must disclose some basis in fact and law that would allow the court to conclude that the continued deprivation of liberty is unlawful." Para 49 restates the onus shift: "After the applicant has discharged the burden of (1) establishing a deprivation of liberty and (2) raising a legitimate ground to question the lawfulness of that deprivation, the onus shifts to the detaining authority to prove the deprivation was lawful."

### B. The Dumas categories — restated, and expressly not rigid

Para 40 (verbatim): "In Dumas, this Court outlined three possible deprivations of liberty within the correctional context: '…the initial deprivation of liberty, a substantial change in conditions [of confinement] amounting to a further deprivation of liberty, and a continuation of the deprivation of liberty' (p. 464)."

Para 41 (verbatim): "I note that **these categories are not exhaustive**, but rather they assist 'in pinpointing the nature of a challenge to a deprivation of liberty for reasons beyond those underlying an initial order' (Chhina, at para. 23). This Court has applied these categories broadly to frame a particular type of deprivation, but **the actual analysis of whether a deprivation has occurred must always be undertaken from a qualitative perspective** (R. v. Gamble, [1988] 2 S.C.R. 595, at p. 644). As stated in Gamble, any distinctions regarding the availability of habeas corpus review that are 'uncertain, technical, artificial and, most importantly, non-purposive should be rejected' (p. 640)."

Para 58 (verbatim, in part): "It is important not to conflate the three Dumas categories, which assist solely in determining the nature of the deprivation, with an analysis of whether there is a deprivation of liberty between two distinct forms of confinement… The analysis must focus on whether the inmate is currently in a state of confinement that is relatively more restrictive of his liberty than where he allegedly ought to be."

Para 60 (verbatim): "An inmate will establish a deprivation of liberty if they demonstrate that their current continuing state of incarceration is more restrictive of their liberty than the allegedly lawful state they seek to be released to."

Two further majority holdings that frame everything else:

- **No entitlement is required at stage one.** Para 63 (verbatim, in part): "Entitlement has never formed part of the analysis for a deprivation of liberty; rather, a legal entitlement to a certain form of incarceration is the outcome of a successful habeas corpus application, after being heard on its merits. A requirement of entitlement at the first stage of an application would preclude an arbitrarily detained applicant from ever having their application heard." Para 67: stage one "does not require that they establish a formal entitlement… This stage should not function to prevent access to the writ based on formalistic distinctions."
- **Paras 23–24 of Dorsey** are the majority's account of the application judge's contrary reading below — the third Dumas category confined to "cases of extended detentions or detentions of uncertain duration" — which the majority's framework discussion (paras 40–43, 58–62) displaces.

### C. Para 44 — the passage Carroccia quoted, in full and in place

Para 44 sits at the **end of the Stage One section**, immediately before the Stage Two heading (para 45). Verbatim, complete:

> "[44] The writ of habeas corpus exists to release a person from an unlawful deprivation of their liberty. Care must be taken not to lose sight of this objective. The first stage functions to filter out frivolous claims where there is no qualitative difference in liberty as between two states of confinement. **All applications for habeas corpus, irrespective of a particular Dumas category, face further filtering at the second stage: raising a legitimate ground to question the lawfulness of the deprivation of their liberty.**"

Carroccia's endorsement quotes the **first three sentences exactly** and stops. The paragraph's fourth sentence — the one that hands the analysis to stage two, the legitimate-ground inquiry — is not quoted and is nowhere picked up in the endorsement.

### D. Paras 68–70 — the classification holding

Para 68 (verbatim): "Turning to the impact of security reclassification decisions within the federal correctional system, in my view, it is clear that their effect may be to unlawfully detain an inmate in a higher, more restrictive facility than they lawfully ought to be detained in. **Federal inmates' security classifications and placements have a profound impact on their qualitative experience of incarceration and, in many instances, also on its duration.**"

Para 69 (verbatim, in part): "Security classification and placement will impact the degree of access an inmate has to correctional programs, rehabilitative opportunities, private family visits, work opportunities, and temporary absences, as well as the eventual timing of their release…"

Para 70 (verbatim): "In my view, **an inmate unlawfully held for an extended period at a higher security facility, having been wrongly denied a reclassification, faces the same deprivation of liberty as an inmate who has been unlawfully transferred to a higher security facility.**"

### E. The majority's own limits

Para 56 (verbatim, in part): "courts have held that denial of or inability to access rehabilitative programming does not constitute a deprivation of liberty (Mapara…; Lord…; Rain…). Furthermore, in Ewanchuk v. Canada (Attorney General), 2017 ABQB 237…, the court held that habeas corpus does not apply in situations involving temporary lock downs and other intermittent forms of detention; rude, abusive, or inattentive staff; exposure to dangerous inmates; complaints about food, medical accommodations, and hygiene; complaints that the inmate grievance procedures are ineffective; inadequate mail services and searches of mail; inadequate access or excessively expensive telephone communications; and restrictions that impede legal research, document preparation, and litigation activities (para. 65). Likewise, in Mennes…, housing an inmate in a double occupancy room instead of a single occupancy room does not engage a deprivation of liberty."

Para 55 (verbatim, in part): "not all carceral conditions will constitute deprivations of liberty… habeas corpus is not meant 'to challenge any and all conditions of confinement in a penitentiary or prison, including the loss of any privilege enjoyed by the general inmate population' (Miller, p. 641)." Para 57: "The mere loss of certain privileges is distinct from an unlawful decision to maintain a more restrictive form of incarceration (Miller, at p. 641)"; and reclassification results "in an insignificant or trivial limitation on an inmate's rights would not constitute a deprivation of liberty" (para 71).

### F. Grading the endorsement's use of Dorsey

Carroccia J.'s endorsement (`~/workspace/vc_matrix_work/carroccia_endorsement_jan28_2026.txt`) deals with Dorsey in one paragraph: "In Dorsey v Canada (Attorney General), 2025 SCC 38, the Supreme Court explained the objective and limits of habeas corpus at paragraph 44:" — followed by the three-sentence quotation — and then moves directly to refusal: custody ("I am advised that Mr. Longo has no outstanding criminal charges in the Superior Court of Justice in Windsor and is not in custody"), remedy ("A Habeas Corpus application cannot provide such a remedy"), and rules non-compliance ("the material filed, which does not comply with the Rules in any event, will not be accepted for filing").

Against the decision read whole:

- **Quoted:** para 44, sentences 1–3 — accurately.
- **Quoted but truncated:** para 44's fourth sentence (the second-stage filter) is omitted, and with it the analytical step it announces.
- **Never engaged:** the two elements / three stages (paras 36–38); the relative, qualitative deprivation analysis (paras 41–43, 58–62); the rule that no prior entitlement need be shown (paras 63–67); the Dumas categories and their non-exhaustiveness (paras 40–41); the onus shift to the detaining authority (paras 38, 49); the non-discretionary-hearing rule (paras 7, 47); the stage-two question — whether the applicant raised *any* legitimate ground, on the low "some basis in fact and law" threshold (paras 45–46) — which the endorsement never asks, although Frank's application pleaded grounds (charges withdrawn/dismissed while records and restrictions persisted, per his §8.2); and the majority's own limits catalogue (para 56), which she also did not apply — his complaints were never classified under it either.
- **Conclusion on the documents:** the endorsement uses Dorsey as a one-paragraph statement of the writ's "objective and limits" and as authority for a filing refusal. **It never runs the test Dorsey sets out** — no stage-one deprivation analysis, no stage-two legitimate-ground inquiry, no onus analysis. Its operative custody proposition rests on the endorsement's own words, "I am advised," whose source no document in the record identifies.
- **Balance, stated plainly because the same standard applies both ways:** Dorsey is a case about incarcerated federal inmates; its stage-one analysis compares **two states of confinement** (paras 40–43, 60). Dorsey does not itself hold that a person in no form of detention obtains habeas, and Frank's application would have faced the stage-one question on its own terms. The endorsement's documented defect is analytical — it cited the framework and did not apply it — not that Dorsey compelled acceptance of the filing.

### G. Verification — the "SMOKING GUN #46" claims against the text

Frank's GenSpark page "SMOKING GUN #46: The Dorsey Deception — How Justice Carroccia Denied Habeas Using Outdated Law" (`https://qkcomnhf.gensparkspace.com/SMOKING_GUN_46_DORSEY_DECEPTION.html`) makes two load-bearing claims. Checked against the judgment text itself:

1. **"The Supreme Court of Canada unanimously ruled…" — FALSE.** The judgment is **6–3** (Part A above; the split is on the face of the document, and the Court's own Case in Brief records that "six judges said yes" over three dissenters). The word "unanimous" appears nowhere in the decision.
2. **"Habeas corpus now applies to 'qualitative deprivations' — you don't need to be behind bars… Surveillance (being watched constantly), Economic ruin, Family separation, Psychological harm… then you are entitled to habeas corpus relief — even if you're not in a jail cell." — NOT IN THE DECISION.** Full-text searches of the complete judgment (majority and dissent): **"surveillance" — zero occurrences. "Economic" — zero occurrences. "Psychological" — exactly one occurrence**, in the dissent's factual recital of Mr. Dorsey's case (para 106: "A 2018 psychological assessment further concluded that Mr. Dorsey was a high risk for violent recidivism") — a fact about an inmate, not a habeas ground, and not in the majority reasons. Every deprivation the majority analyses is a comparison between states of confinement of persons already incarcerated (paras 40–43, 60, 68–70).
3. What the page gets **right**: its quotation of para 44 is accurate; Dorsey did broaden access (denial of reclassification can itself be a deprivation; no entitlement required at stage one; categories not exhaustive; qualitative approach).
4. The page's characterization of Carroccia's citation as "selective citation — a form of obstruction of justice (s. 139 CCC)": the selectivity is documented at Part F above (three of para 44's four sentences; none of the framework). "Obstruction of justice" is a criminal-law characterization; it appears nowhere in Dorsey and is not established by anything in this record — this file records the omission, not the offence.
5. The same standard applied to Frank's own renewed application: its §8.2 summary ("Physical custody not required for habeas corpus… class actions by prisoners in non-physical restraints") over-reads the decision in the same direction. Dorsey's text supports the procedural complaint — the test was cited and not run — without supporting either side's extension of the writ beyond the confinement comparison the majority actually decided.
